Delivery Information
At Hardy’s of Kilkeel, we use our own fleet of vehicles to deliver to most of Northern Ireland and many parts of Southern Ireland. Our retail showroom and warehouse are located in Kilkeel, County Down, Northern Ireland. Most of the Newry, Mourne & Down District area deliveries are provided free of charge. We also provide professional installation services and recycling of your old products.
We sell and deliver products throughout the UK & Ireland and if you happen to live outside of our main delivery area, we use only the best courier companies to deliver your merchandise.
For pricing purposes, we have divided the UK & Ireland into Zones. We consider American food centres and Range style cookers to be extra large items. Major appliances like dishwashers, washing machines, tumble dryers, fridges, freezers, ovens and TVs over 40" fall into the large category. Small items include small kitchen appliances, e.g., kettles, toasters & food mixers. Remotes, batteries, cables & filters are all classed as accessories.
DELIVERY CHARGES
We deliver daily to the Newry, Mourne & Down District areas from Monday-Saturday. Our vehicles also deliver at least once a week to the Antrim, Armagh & Dublin areas, including Belfast.
We have divided Northern Ireland into four delivery zones. Each zone has a different pricing structure. The tables below are designed to give you an estimate. Exact pricing will be calculated at checkout.

We have divided the Rest of Ireland into two delivery zones. We deliver to the Dublin area at least once a week using our own vehicles. We also use a courier service for Zone 2 and some of Zone 1.

STOCK ITEMS
Items which we hold in stock will usually be delivered the next working day to the Newry & Mourne Area, or on the day of your choice (you can choose the day that suits you at checkout.)
For the Antrim, Armagh & Dublin Areas, delivery will be made the next day we have an available delivery van in your area. (Our vehicles deliver at least once a week to the Antrim, Armagh & Dublin areas, including Belfast.)
Once you have placed your order, we will contact you the following morning (usually before 9.30am) via telephone or email to schedule delivery and provide you with an approximate four-hour time frame of the delivery. (Please be aware this time slot is only an estimate. We always do our best to meet delivery times, however, occasionally there may be delays due to circumstances beyond our control.) Upon delivery, a signature will be required as acceptance of the product(s).
We also use a courier service for some smaller items and for any deliveries made outside of our target area. We aim to have these orders ready for collection the next working day. For more information about our courier service please read the information in section titled ‘Courier Delivery’ below.
SPECIAL ORDER ITEMS
Delivery lead times will be longer for items which we do not carry in stock. These products will need to be specially order from our supplier(s) and time scales vary depending on the manufacturer and the product availability. Generally, it should take around 7-14 working days from the day you place your order until we receive the item(s) into our warehouse.
DELIVERING SAFELY
In order to ensure a quick and safe delivery every time, it is recommended that you make us aware of any special requirements or site related restrictions that may hinder our delivery drivers. This can include steps, narrow doorways, soft path ways, road access, etc.
We offer Standard Two Man Delivery regardless of how many items you have in an order. We do not offer a service of carrying large, heavy products upstairs. We will only deliver to ground floor properties (unless a lift is available); this can include a maximum of 4 steps, exterior and interior inclusive. Any lifting/carrying is at our driver’s discretion.
We reserve the right to refuse delivery where, in our delivery driver’s opinion, it would put our staff at risk. If a delivery cannot be made by our Two Man Delivery Service, because the customer order falls outside of the above parameters, a redelivery charge of £19.99 will apply. The delivery would then be arranged for the next day we have an available delivery van in your area.
ITEMS OVER 70cm IN WIDTH
We strongly advise you call our store to arrange delivery before ordering or purchasing large items over 70cm in width, e.g., American style fridge freezers, range cookers, etc. It is always beneficial for both parties to check there are no obsticles which may cause a failed delivery. Our Two Man Delivery ensures a safe delivery into a ground floor room of your choice with no more than 4 steps, interior and exterior inclusive.
We strongly advise all customers not to book fitters until they have received the relevant goods, as no claims will be accepted. We shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in delivering goods.
FAILURE TO ACCEPT DELIVERY
Failed delivery charges may be applied in the event that a delivery fails due to – but not limited to - any of the following reasons:
- You cancel the order after the point at which the goods have been loaded for delivery at our warehouse.
- You provide insufficient/incorrect contact details or an incorrect delivery address thereby resulting in our inability to contact you or otherwise make a successful delivery.
- You refuse delivery upon arrival of our delivery vehicle.
- There is no-one at the delivery address to accept delivery. (You must ensure that you can be available all day on your confirmed day of delivery.)
- There are parking restrictions or other access problems (e.g. stairs or narrow doorways) which you failed to notify us about. By booking your own delivery date at the checkout you are agreeing that there are no such access or parking restrictions which we should be aware of.
Once the delivery has been accepted at the delivery address you have a duty of care for the goods. In the event that you, or a third party, transport the goods from the delivery address to another location we cannot be held responsible for any damages.
COURIER DELIVERY
Assuming the item is in stock, we aim to have your order ready for collection the following working day.
We have a selection of excellent transport companies with whom we have been working with for many years in order to deliver to postcodes outside of our target area. However, the main courier we use is IFS Global Logistics.
Once we have your item(s) ready, we notify IFS to collect it from our warehouse. They will then deliver it to you on our behalf, usually within 2-3 working days from the time of collection. IFS will send you 3 emails regarding the status of your delivery. The first email will confirm collection from us, the second email tells you when the item(s) is out for delivery and the final email informs you when it has been successful delivery.
Unfortunately, we are only able to provide a drop-off service at this time. All deliveries will be made to the main entrance of your home and a signature will be required upon delivery. If you have a shared entrance – if you live in an apartment block, for example – this means we’ll bring it to your apartment, not just the front entrance of the building. We advise you to be available or make provisions for an adult to be available between the hours of 8am-6pm on the day of delivery to accept the goods upon arrival of our delivery vehicle.
Delivery dates should only ever be considered as estimates at all times. Occasionally there may be delays without prior notice (e.g. due to stock availability, weather, or delivery vehicle breakdowns), which is why we strongly advise all customers not to book fitters until they have received the relevant goods, as no claims will be accepted. We shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in delivering goods.
Acceptance of your order takes place when the goods have been loaded onto our couriers vehicle for delivery to you. You will receive a delivery confirmation email at this stage. If you find you cannot keep to the delivery date you must notify us before 12 noon one working day before delivery.

Customers cannot under any circumstances assist the driver with delivery or handling of any of our products.
Once the delivery has been accepted at the delivery address you have a duty of care for the goods. In the event that you, or a third party, transport the goods from the delivery address to another location we cannot be held responsible for any damages.

Items Ordered Online
You must notify us in writing of your wish to cancel your order within 14 days, starting the day after delivery of goods.
You then have the choice of returning the goods via your own means, or requesting that we collect the goods.
If you request a collection of the goods we will collect the goods on the next available date that one of our delivery vehicles is in your area. If you are not ordering a replacement then this service we offer will incuur costs of £49.99 per item.
If you chose to return the goods via your own means you will bear the direct costs of returning the goods to Hardy’s of Kilkeel, 40-48 Newry Street, Kilkeel, Newry, County Down, BT344DN.
You have a duty of care while the goods are in your possession and we reserve the right to charge you for any damage that may have occurred during this period.
Full refunds will be provided for items which are returned to us in their original condition. This means:-
- The returned goods must be unused and 'as new' with their original box and packaging including all manuals (please do not mark or handwrite on manuals) and/or supplied accessories.
We reserve the right to apply re-handling charges for returned items under some circumstances as outlined below:-
The goods received back are 'as new' but incomplete; i.e. missing components and/or accessories.
We will not accept returns for unwanted goods and will not provide refunds under the following circumstances:-
- The goods you wish to return are in any condition other than 'as new'.
- The goods have been installed and/or used. This is classed as acceptance of goods.
- Wires, plugs, cables have been cut/removed or tampered. Refunds will be issued within 14 working days of the cancellation date, after we receive the product(s) in question and have had the opportunity to fully inspect them in order to ensure that the condition of the product(s) is in line with our duty of care terms and conditions.
Items Purchased In Store
We do not offer refunds for wrongly ordered or unwanted goods purchased in store. At our discretion we may on occassion offer a credit note with 12 Month expiry date or you will be offered an exchange and part credit note.

We’ll never sell your information. We’ll always comply with all relevant data protection legislation (including the General Data Protection Regulation).
We use third party payment service providers which are integrated into our website. When you pay using one of these methods e.g. PayPal, you are redirected to the provider’s portal.
WHAT IF I WANT TO RENT YOUR PRODUCTS?
If you decide to rent one of our products we may collect further information such as your date of birth and bank details along with proof of identity. We rely on your consent for the purposes of undertaking the checks necessary before entering a rental agreement with you. We may process this information to maintain the rental agreement & to ensure affordability prior to renting one of our products. We may contact you prior to your payment due date to remind about your upcoming payment. If you fail to make payments in line with the rental agreement, we may contact you via telephone, SMS, email and post to ensure the arrears are cleared.
If we contact you during this process and we feel that you may be considered a vulnerable individual we may need to ask you for sensitive information and may require medical information from you. We will always request consent when processing information regarding vulnerable customers. We will share your information with your local authority and with Hitachi Capital (UK) PLC who will act as a credit reference agency. We will also need to share your information to complete anti-money laundering checks. We would retain your data for 6 years following the termination of your rental agreement.

HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
Firstly, don’t panic if you make any mistakes during your order, you can correct any input errors right up until you confirm payment. Once you’re happy everything is correct and you’ve submitted an order you’ll be given an Order Reference Number and details of the products (and/or services) you have ordered.
You‘ll then receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the Dispatch Confirmation) also lets you know how your products will be delivered to you. The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation. If we have to cancel all or part of your order for any reason, we will email you to let you know.
The Contract will relate only to those Products or services whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
If you have placed an order by telephone and you don't have an email address, we'll give you the Order Reference Number over the phone and post you a copy of your receipt.
We take all reasonable steps to ensure all details, descriptions and prices of products and services are correct at the time the information was entered onto the system. Sometimes we have to hold our hands up and admit we have made a mistake by unintentionally publishing inaccurate information on the site (e.g. the price, description or availability of a product you have ordered). In this instance we may have to cancel your order at any time, even if you have received your Order Confirmation email, and you will receive a full refund of any charges already paid.
If you choose our Reserve and Collect service you will be given a reference number and details of your order. You will not be asked to pay until you collect the goods from your chosen store.
Because all Reserve & Collect sales take place in our stores, sales are subject to the normal in-store terms of sale, statutory rights and the Manager's discretion. Just take your Reserve & Collect print out and/or reference number with you and our store will sell you the goods at the website price or store price, whichever is cheaper.
CONSUMER RIGHTS
If you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our Returns Policy. To cancel a Contract, you must inform us in writing. You must also return the Product(s) to us immediately, in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
This provision does not affect your statutory rights.
PRICES AND PAYMENTS
As you would expect all our prices are in pounds sterling. The total cost of your order will be the price of the products you order, the delivery charge (if any), plus any additional services you choose e.g. premium delivery or installation. You’ll see all these in your Shopping Basket before you submit an order. Payment is deducted once an order is submitted.
- The price of any Products will be as quoted on our site from time to time, except in cases of obvious error.
- These prices include VAT charged at the current rate but exclude delivery costs, which will be added to the total amount due.
- Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

- We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.
- Payment for all Products will be via our credit card services provider, Sage Pay. This service is fully secure and bank endorsed, and utilises a range of industry standard and Sage Pay unique security and fraud prevention systems, combined with fault tolerant secure server networks and firewalls. Sage Pay has the highest level of card data security (PCI DSS Level 1 compliant).
When deciding whether to accept your order we may use certain information about you, including any received from our accredited identity verification partner. For example, we may pass on your details for them to check against certain public and private databases. This will help to protect you and us from fraudulent activities.
If we identify a transaction as being potentially fraudulent, we may ask our courier to return the goods to our warehouse, we may cancel your order even though you will have received the Order Confirmation email.
OUR REFUNDS POLICY
When you return a Product to us:
because you have cancelled the Contract between us within the seven-day cooling-off period (see Consumer Rights above), we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, we will refund the price of the Product in full, including delivery charges. However, you will be responsible for the cost of returning the item to us.

DELIVERY AND INSTALATION SERVICES

DISCONNECTION OF YOUR OLD APPLIANCES
You’ll need to have safely disconnected your old appliance prior to our arrival unless you have chosen one of our installation services for your new product. Gas and dual fuel cookers must be disconnected by a Gas Safe registered engineer and mains wired electric cookers should only be disconnected by a qualified person.
DAMAGED, MISSING OR INCORRECT ORDERS
We want you to be absolutely satisfied with your product and would recommend that, where practicable, you unpack and check it for damage as soon as it arrives. If you receive a damaged product please contact us as soon as the damage is discovered via the Contact Us facility on the Customer Services page.
We do everything we can to ensure your order arrives at your door complete and in pristine condition. If you don’t receive all your products at once, you can check that they have been dispatched using our tracking facility detailed in the confirmation email. If it’s not on its way, you can contact us via the Contact Us facility on the Customer Services page or telephone 028 417 63366. In the unlikely event that the product is faulty, please follow the instructions in the delivery documents.

WARRANTIES

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
Strikes, lock-outs or other industrial action.
Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
Impossibility of the use of public or private telecommunications networks.
The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
WAIVER
If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause Written Communications above.
SEVERABILITY
If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
ENTIRE AGREEMENT
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing. We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract. While we accept responsibility for statements and representations made by our duly authorised agents, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.
SECURITY
You agree not to interfere, disrupt, or attempt to interfere or disrupt the operation of the Website or of the networks connected to the Website, and to abide by all security policies adopted by Hardy’s of Kilkeel. You acknowledge and agree that, for security purposes, Hardy’s of Kilkeel may monitor your account and your access to and use of the Website. Hardy’s of Kilkeel may at any time terminate or suspend your access to the Website as Hardy’s of Kilkeel considers appropriate or necessary in its sole discretion for security reasons, as a result of non-payment, any alleged or suspected breach of these Terms and Conditions, or to protect intellectual property. INDEMNIFICATION

APPLICABLE LAW
Contracts for the purchase of Products & services through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by the laws of Northern Ireland. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
